Stephane Marchand misses court date when arrested for domestic violence

UPDATES:  Due to privacy reasons, the OCSD jailers do not discuss the reasons for arrest.  In a review of all files and sources, it turns out that the reason Mr. Marchand was not in court, was because he was in jail for battery on a spouse, and that he was arrested in 7/19, the night before he was due in court on the burglary charges.

Stephane Roger Marchand, who was originally arrested on February 5 for an alleged burglary of a house in his Ladera Ranch neighborhood, failed to appear in court at Harbor Justice Center on Wednesday the 20th where he was due for a pre-trial hearing.  

LaderaPortal NEWS was in court on Wednesday to cover the pre-trial hearing, but Marchand was not in the courtroom.  When the accused failed to appear, Judge Stephanie George issued two bench warrants totaling $35,000.  
 
OCSD deputies didn't have far to look, as Marchand was already sitting in jail after a domestic violence arrest the night before. 
 
He was brought from jail to court for the pre-trial hearing on Thursday where two further hearings were set for two different cases.  One of the cases is for the alleged burglary, and the second for an alleged violation of probation involving a 2009 case where he was convicted of practicing law and real estate without a license.
 
Marchand pled not guilty to the charges at his June 20 arraignment.  He was unable to retain counsel and is now being represented by the Orange County Public Defender.  

Marchand posted bond on Friday, July 22 and is currently released on bail.  He is due back in court on July 28 for a hearing on his alleged probation violation and also on Tuesday, August 2 for a preliminary hearing in the burglary case, where the judge will hear evidence and determine if it is sufficient to order a trial.

Bring your low back chairs, blankets, and picnics. Please do not bring umbrellas/shade covers and no pets are allowed during the concerts. Be sure to bring some cash to enjoy a treat from one of the concession stands."

Ladera Ranchers began laying out chairs and blankets in the early morning hours, building to near capacity by 4:30PM.  If you want to get your space... plan ahead.  The rest of the summer concerts are as follows:

Ladera Relay for Life raises over $20,000 for Cancer Research

According to organizers of the Ladera Relay for Life, an organized externsion of the American Cancer Society, the group raised 400% more than the previous year and was able to rally contributions from Ladera Ranch residents with support from Mrs. California 2011, Jennifer Glava and Disney Channel star Roshan Fegan of "Shake it up!" fame.  

The event was held at Stoneybrooke school at the intersection of O'Neill and Sienna in south Ladera Ranch (there are two O'Neill/Sienna intersections), where dozens of families camped out and walked mile after pledged mile in order to raise funds for cancer research.  

The event featured most prominently, a "survivor's lap", where cancer survivors walked around a track laid out around the grounds at Stoneybrooke in celebration of their victory over cancer.  The aim of the event is to have more survivors through increased research and results.

Stephane Marchand arraignment postponed due to lack of counsel

Stephane Marchand arrived in Judge Stephanie George's courtroom this morning at the Harbor Justice Center in Newport Beach wearing a black suit with no tie and carrying a small attache case.  He mused about until the court room was opened and then proceeded to the bailiff to check in and inform the court that he was waiting on his attorney, whom he claimed was James Sunseri. 

 

Sunseri successfully argued for a dismissal in a 2005 case against Marchand where he was accused of four misdemeanors including criminal threats, battery against co-habitant, dissuading a witness from testifying and child abuse and endangerment. 

 

When his case was called this morning, Marchand said to the judge, "My attorney was supposed to be here."  

 

"Who is your attorney?" asked Judge George, to which the clerk responded, "Sunseri". 

 

"We'll give him a call," said the judge as she turned to the clerk for acknowledgement of the request.  

 

Marchand spoke quickly.  "My wife just left me a message, saying that he needs me to come to his office for some paperwork."

 

"So you don't have retained counsel," said the Judge.  

 

"Well I paid him some money already," quipped Marchand. 

 

Judge George explained that the case had a special circumstance; that there was a media request for cameras in the courtroom, and that she wanted to give Marchand the opportunity to have counsel present.

 

Marchand interrupted her explanation to say, "I would like to oppose that, your honor."  He continued, referring to the media request. "There's a restraining order that says that I can't be within a hundred feet of him, and he can't be within a hundred feet of me."  Marchand gestured in the direction of LaderaPortal NEWS editor and author of this story, Bo Kelleher, who has a protective order against Marchand.  The order was served just after midnight Tuesday by an OC Sheriff deputy after a judicial officer deemed that threatening emails from Marchand amounted to "stalking".  The order is not bi-directional, as Marchand wrongly told the judge.  

 

Judge George stopped Marchand, saying: "You need to stop talking so much.  You're really not helping yourself."  She went on.  "This is a very formal setting and everything you say here can incriminate you.  None of these people up here [pointing at the Assistant District Attorneys] are your friends an you need to watch what you say." 

 

She asked Mr. Marchand what he wanted to do about counsel and he prevaricated, first indicating that he wanted a public defender, and then saying that he wanted time to hire an attorney. 

 

The judge explained to Marchand, "The public defender is generally for people that don't have any income.  You could apply for that and see if you qualify."

 

Marchand's luck with the public defender has not been as good as it was with private attorneys.  In 2009, he was arraigned in custody (jail) for four counts of grand theft, one count of petty theft, felony vandalism and two counts each of practicing law and real estate without a license.  In a plea deal, all of the felony counts were dismissed, but Marchand pled guilty to two misdemeanors that carried three years of probation.  The Orange County DA is now saying that because of the most recent burglary charge, that he is in violation of the terms of that probation.  

 

Marchand said that he has the funds to retain an attorney.

 

The judge asked Marchand how long he would need to hire counsel and he indicated that he would need three weeks. 

 

Judge George made some admonitions about speedy trial rights being waived and agreed to move the arraignment date to June 3, 2011.

Anaheim School Guidance Counselor Sues Stephane Marchand for over $100,000

Stephane Marchand is being sued for Fraud by an Anaheim school guidance counselor who took out $25,000 in loans to fund Marchand's plan to take Altitude Entertainment public through either a reverse merger or an IPO.

At the request of the plaintiff, LaderaPortal has redacted his name.
